Terms of service
These Terms of service ("Terms") govern access to and use of the Woopets AI service, available at woopets.ai and operated by SAS Digistart.
1. Purpose of the service
Woopets AI is a conversational platform that gives users access to virtual pet care experts (veterinarians, behaviorists, nutritionists, etc.) powered by artificial intelligence. The service allows pet owners to ask questions about the health, behavior, nutrition and lifestyle of their companion, and receive personalized informational advice.
2. Important medical disclaimer
The advice provided by Woopets AI virtual experts is delivered for informational purposes only and is no substitute for the opinion of a qualified veterinarian. In case of worrying symptoms, doubt, injury or emergency concerning your animal, consult a veterinarian immediately. SAS Digistart cannot be held responsible for the consequences of using the advice in place of a veterinary consultation.
3. Acceptance of the Terms
Use of the service implies full and unconditional acceptance of these Terms and of the Privacy policy. When creating an account, the user explicitly validates their acceptance via a dedicated checkbox. This acceptance is timestamped and stored for evidence purposes.
4. Account creation
Creating an account requires a valid email address, a password of at least 8 characters and a display name. The service is reserved for persons aged 15 or over. The user undertakes to provide accurate information and to maintain the confidentiality of their credentials. Any use of the account is presumed to be made by its holder.
5. User commitments
The user undertakes to use the service in a fair manner and in accordance with its purpose. The following are notably prohibited: any unlawful use, harassment, defamation, distribution of illegal or offensive content, creation of fake accounts, automated scraping, attempts to bypass security measures or usage limits, and any use that impairs the operation of the service.
6. Service availability and changes
The service is provided free of charge and may evolve. SAS Digistart reserves the right to modify, suspend or discontinue all or part of the service at any time, without notice or compensation. No availability commitment is guaranteed, particularly in the event of maintenance, network outage or force majeure.
7. Limitation of liability
The service relies on artificial intelligence models that may produce inaccurate, incomplete or unsuitable answers. SAS Digistart does not guarantee the accuracy of generated advice and cannot be held liable for direct or indirect damages resulting from its use. The user remains solely responsible for decisions made regarding the health and well-being of their animal.
8. Intellectual property
The platform, its interface, brand, content and knowledge base are the exclusive property of SAS Digistart. The user retains all rights to the messages they write, but grants SAS Digistart a non-exclusive, free license, limited to the duration of the account and to what is strictly necessary to operate the service (storage, history display, anonymized service-improvement processing).
9. Termination
The user may terminate their account at any time from the "My account" page. SAS Digistart reserves the right to suspend or delete an account in case of breach of these Terms, particularly in case of proven abuse (see moderation system). Termination triggers the gradual deletion of data in accordance with the Privacy policy.
10. Applicable law and jurisdiction
These Terms are governed by French law. In case of dispute and failing amicable resolution, the competent courts shall be those of the jurisdiction of SAS Digistart's registered office, subject to mandatory contrary provisions applicable to consumers.
11. Consumer mediation
In accordance with articles L.611-1 and following of the French Consumer Code, a consumer user may, in case of unresolved dispute, use the consumer mediation service free of charge. A prior written complaint must have been sent to contact@digistart.fr.
